Terms of Service

These terms govern the use of the HiperXomnia platform (the "Service") by a business ("you", the "Client"). By creating an account or connecting a WhatsApp Business Account you accept them.
1. What the Service is
HiperXomnia is a Meta Tech Provider: a SaaS platform that lets other businesses connect and manage their own WhatsApp Business Accounts. We provide the console, the integration with Meta's Cloud API and the storage of your conversations. We are not WhatsApp and we are not Meta, and we do not resell phone numbers.
2. Your account
- You must provide accurate business details and keep your credentials secure.
- You are responsible for everything done through your workspace, including by your team members.
- You must be authorized to act on behalf of the business whose account you connect.
3. Ownership of your WhatsApp assets
Your business portfolio, your WhatsApp Business Account and your phone number remain yours. By completing Embedded Signup you grant us the whatsapp_business_management and whatsapp_business_messaging permissions, limited to the assets you selected, so that we can operate the Service for you. You can revoke that access at any time from the console or from your Meta business settings.
4. Your obligations when messaging
- You must obtain a valid opt-in from every end user before sending them a business-initiated message, and keep the evidence of it.
- You must honour opt-out requests promptly. The platform blocks sends once one is recorded.
- You must comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and all applicable law, including data protection and consumer protection rules.
- You must not use the Service for spam, unsolicited marketing, deceptive content, or any content prohibited by Meta.
Breaching these obligations can lead to your phone number being rate-limited or banned by Meta. We may suspend a workspace that puts our platform or other clients at risk.
5. Fees
Plan fees, if any, are the ones agreed in writing with you. Messaging charges billed by Meta for conversations on your WhatsApp Business Account are separate and are your responsibility.
6. Availability and support
We work to keep the Service available, but we do not guarantee uninterrupted operation. Parts of the Service depend on Meta's platform and on its availability and policies. Support is provided by email at hyperommnia@gmail.com.
7. Data protection
Our handling of personal data is described in the Privacy Policy. In respect of your end users' data you act as controller and we act as processor, following your documented instructions.
8. Termination
You may stop using the Service and disconnect your WhatsApp Business Account at any time from the console. On termination we revoke our access to your account, destroy the stored access token and delete your data as described in the Data Deletion Instructions.
9. Liability
To the maximum extent permitted by law, our aggregate liability arising from the Service is limited to the amount you paid us in the three months preceding the event. We are not liable for indirect or consequential damages, nor for decisions taken by Meta regarding your account, your templates or your phone number.
10. Changes
We may update these terms. Material changes will be communicated to the contact address on your account, and the date at the top of this page will be updated.
